Key Services Areas

Background

After completing Articles and one year of general practice, Madelaine worked in a London Law firm in its commercial property department.  Upon returning to Melbourne in 1983 she worked in the litigation departments of two major legal firms where she gained extensive experience in professional indemnity and insurance litigation, banking and securities litigation, insolvency litigation and general commercial litigation.  Madelaine became a Senior Associate before taking a break from practice in 1994 to raise her children.

Madelaine returned to practice in 2005 by joining Hicks and Oakley (before the merger with Chessell Williams) and has conducted extensive Wills and Estates Litigation.  This has included Part IV claims, general wills disputes and the much publicised wills case of Nicholson and Ors v Knaggs and Ors [2009] VSC 64.  This case ran continuously for almost six years, was tried in the Supreme Court over 31 sitting days, and effectively changed the law surrounding the principles of undue influence in will-making.

Interests

Madelaine is closely involved with Wavecare Counselling Service in Glen Waverley, to which she provides pro bono legal advice. This organisation looks after the social welfare of the Monash Community.

Madelaine enjoys playing tennis, bush walking and spending time with her children.
