A mediation is almost always ordered by a court as part of the litigation process. The mediator may be a court officer (a judicial mediation) or the court may require the parties to choose their own private mediator. Many cases are able to be resolved at or shortly after mediation, which avoids the costs of a contested trial and the steps needed to prepare for trial.
