Superannuation & Binding Death Benefit Nominations

Who gets the superannuation benefits when a person dies?

Superannuation is generally outside of your estate and it is therefore not automatically an asset to be dealt with and distributed under a Will.  Rather, the trustee of the super fund determines who gets your super unless you made a binding nomination in favour of one or more dependents or your legal personal representative.

Careful thought needs to be given as to who should be nominated and our wills & estates lawyers are well placed to advise about this.

Life Insurance

Like superannuation, death benefits payable under a life insurance policy do not form part of a deceased's estate. This is yet another reason to make and update a binding death benefit nomination.
